Paazeb Silver ("we", "us", "our") operates this store and website, including all related information, content, features, tools, products and services (the "Services"), to provide you with a curated shopping experience. Paazeb Silver is powered by Shopify, which enables us to provide the Services to you.
This Privacy Policy describes how we, as a "Data Fiduciary" under the Digital Personal Data Protection Act, 2023 ("DPDP Act") and the Digital Personal Data Protection Rules, 2025 ("DPDP Rules"), collect, use, store, and disclose your personal data when you visit, use, or make a purchase or other transaction using the Services, or otherwise communicate with us. This Policy is also framed with reference to the Information Technology Act, 2000, the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011, and the Consumer Protection (E-Commerce) Rules, 2020, to the extent applicable.
If there is a conflict between our Terms of Service and this Privacy Policy, this Privacy Policy will control with respect to the collection, processing, and disclosure of your personal data.
Please read this Privacy Policy carefully. By using or accessing the Services, providing your personal data to us, or making a purchase, you acknowledge that you have read and understood this Privacy Policy.

1. Personal Data We Collect
Under the DPDP Act, "personal data" means any data about an individual who is identifiable by or in relation to such data. We may collect the following categories of personal data, depending on how you interact with the Services:
• Contact details — name, billing address, shipping address, phone number, and email address.
• Financial information — payment card details, UPI/bank account information, transaction details, payment confirmations, and other payment-related information (processed primarily by our payment gateway partners and Shopify; we do not store full card numbers on our own systems).
• Account information — username, password, security questions, preferences, and settings.
• Transaction information — items viewed, added to cart or wishlist, purchased, returned, exchanged, or cancelled, and your order history.
• Communications — information you share with us, including customer support queries, reviews, and feedback.
• Device and usage information — IP address, browser type, device identifiers, and information about how you navigate and interact with the Services (including via cookies and similar technologies).
We do not knowingly collect any special category or sensitive personal data (such as health, biometric, religious, or similarly sensitive information) beyond what is necessary for payment processing.

2. How We Collect Your Personal Data
• Directly from you — when you create an account, place an order, contact us, subscribe to updates, or otherwise provide information to us.
• Automatically — through your use of the Services, and through cookies and similar tracking technologies.
• From our service providers (Data Processors) — such as Shopify, payment gateways, and courier/logistics partners, who process personal data on our behalf and under our instructions.
• From third parties — such as marketing or advertising partners, where you have separately consented to such sharing.

3. Consent
We collect and process your personal data only on the basis of your clear, specific, informed, and unambiguous consent, given through an affirmative action (such as checking a box, placing an order, or creating an account), except where processing is permitted without consent under the DPDP Act (for example, for certain "legitimate uses" such as fulfilling a contract you have entered into with us, or to comply with a legal obligation).
Where we rely on your consent:
• We will provide an itemised notice, in clear and plain language, describing the personal data being collected and the purpose of processing, at or before the time we seek consent.
• You may withdraw your consent at any time, with the withdrawal being as easy as it was to give consent. You can do this by contacting us using the details in Section 12 below. Withdrawal of consent will not affect the lawfulness of processing carried out before withdrawal, and may affect our ability to provide certain Services to you (for example, we may be unable to process or ship an existing order).

4. How We Use Your Personal Data
We use your personal data for the following purposes:
• To provide and improve the Services — process payments, fulfil and ship orders, manage returns/exchanges/cancellations, maintain your account, and personalise your shopping experience.
• Marketing and promotions — with your consent, to send you offers, new arrivals, and promotional communications via email, SMS, or WhatsApp. You may opt out at any time (see Section 8).
• Security and fraud prevention — to authenticate accounts, secure payments, and detect or prevent fraudulent or unlawful activity.
• Customer support — to respond to your queries, complaints, and service requests.
• Legal compliance — to comply with applicable Indian law, respond to lawful requests from government or law enforcement authorities, and enforce our Terms & Conditions and other policies.

5. How We Disclose Your Personal Data
We may share your personal data with:
• Shopify and other Data Processors who perform services on our behalf, including payment processing, IT hosting, data analytics, customer support, cloud storage, and order fulfilment/shipping — under contractual obligations requiring them to protect your data and use it only for the specified purpose.
• Marketing and advertising partners, where you have consented to receive personalised advertising or marketing.
• Third parties you direct us to share data with, such as courier partners for delivery, or where you use social login/widgets.
• Our affiliates, within our corporate group, for the purposes described in this Policy.
• Government and regulatory authorities, where required under applicable Indian law, in connection with a legal proceeding, or to protect our rights, property, or the safety of our users.
• A successor entity, in connection with a merger, acquisition, or sale of business assets.
We do not sell your personal data to third parties for monetary consideration.

6. Relationship with Shopify
The Services are hosted on Shopify's platform, which processes personal data relating to your access to and use of the Services in order to provide and improve the Services. Shopify may act as a Data Processor on our behalf and, for certain Shopify-wide features (such as fraud prevention or platform-level analytics across merchants), Shopify may independently determine the purpose of processing. You may review Shopify's own privacy practices at their Consumer Privacy Policy and exercise applicable rights through the Shopify Privacy Portal.

7. Cross-Border Data Transfers
We may store and process your personal data on servers located outside India, including through Shopify's global infrastructure. Under the DPDP Act, transfer of personal data outside India is permitted by default, except to countries or territories that may be specifically restricted by the Central Government of India by notification. We will ensure that any such transfer is carried out in compliance with applicable Indian law as in force at the relevant time.

8. Your Rights
As a Data Principal under the DPDP Act, you have the following rights in relation to your personal data, subject to applicable conditions and exceptions:
• Right to Access — to obtain a summary of the personal data we hold about you and the processing activities undertaken.
• Right to Correction and Erasure — to request correction of inaccurate or incomplete personal data, and to request erasure of personal data that is no longer necessary for the purpose it was collected, unless retention is required by law.
• Right to Grievance Redressal — to have any complaint about our processing of your personal data addressed in a timely manner (see Section 11).
• Right to Nominate — to nominate another individual to exercise your rights under the DPDP Act on your behalf, in the event of your death or incapacity.
• Right to Withdraw Consent — as described in Section 3.
To exercise any of these rights, please contact us using the details in Section 12. We may need to verify your identity before processing your request, and we will respond within the timelines prescribed under the DPDP Rules.
Managing Marketing Communications
You may opt out of promotional emails, SMS, or WhatsApp messages at any time using the unsubscribe link in our communications, or by contacting us directly. You will continue to receive non-promotional, transactional communications (such as order and account updates) even after opting out of marketing.

9. Children's Data
The Services are not intended for use by individuals under 18 years of age. We do not knowingly collect personal data from children without verifiable consent from a parent or lawful guardian. If you believe a child has provided us with personal data without such consent, please contact us using the details in Section 12 so that we can delete it.

10. Security and Retention
We implement reasonable security practices and procedures, in line with the IT Act, 2000 and applicable rules, to protect your personal data against unauthorised access, disclosure, alteration, or destruction. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.
We retain personal data only for as long as necessary to fulfil the purpose for which it was collected — including to provide the Services, comply with legal, tax, or accounting obligations, and resolve disputes — after which it is deleted or anonymised, unless a longer retention period is required or permitted by law.
In the event of a personal data breach that is likely to affect you, we will notify you and the Data Protection Board of India in accordance with the DPDP Rules.
